Taking a case to the Court of Human Rights: An overview

Nichola Higgins provides an overview of what is involved in taking a case to Court of Human Rights looking first at the tools and then the steps needed.

These include: the Admissibility Criteria; the Court Rules and Practice Directions; opening a file by way of letter; the application form; the admissibility procedure; and considering admissibility and merits.

In the Post-Admissibility phase, the practitioner may encounter fact-finding hearings, friendly settlement, striking out, and the final submission to the ECHR.
