John Burton persuaded the Court of Appeal to quash the conviction of Ms SM on the one charge she had been found guilty of.

John argued that the conviction was unsafe on a number of grounds including that some of the documents left for the jury's consideration could not fall within the legislation and that her acquittal on Count 1 by the jury meant in the circumstances she could not be guilty of Count 2. The Crown eventually conceded the point and the conviction was quashed by the Court of Appeal on 17th June 2008.
