Counsel secures unanimous not guilty verdicts for baseball bat and hammer attacks.
Following a trial for causing GBH with intent and inflicting GBH with intent contrary to S18 & S20 of the Offences Against The Persons Act 1861, Mr Power secured the unanimous acquittal of LE on both counts.
The Crown's case was that the victim was sure who had carried out the attack in that he had gone to school with the defendant and so was able to identify him. The Crown sought to rely on what they described as an independent witness, who witnessed the attack from her bedroom window and knew the defendant extremely well. After lengthy cross examination of the prosecution witnesses, counsel advised his client not to give evidence. After a short retirement the jury returned unanimous not guilty verdicts.
