Anand Beharrylal secures unanimous acquittal in alleged Rape and Firearms case

[Image] Gavel and scales

Anand Beharrylal appeared for the first defendant in a two handed case involving kidnapping, multiple counts of rape, sexual assault and possession of a firearm with intent to cause fear of violence before the Crown Court at Snaresbrook.

The Crown alleged that GH and AB kidnapped the complainant, took her to a secure location and held her against her will. Whilst with her kidnappers it was alleged that the complainant was subjected to the sexual allegations and threatened with a loaded firearm. The Crown also introduced cell site and telephone evidence to support the allegations of kidnapping and called other witnesses to support collateral aspects of the prosecution case.

The defence vigorously challenged the credibility, character and evidence of the complainant as being wholly untruthful. The supporting evidence was also challenged as being a combination of mistaken and exaggerated accounts. It was elicited in cross-examination that the complainant was in fact a drug dealer and was in the middle of a drugs deal at the time of the alleged kidnapping. The complainant's allegations were also challenged, where the first defendant was concerned, as having arisen in the context of her drug use and drug dealing.
After a two week trial the defendants were unanimously acquitted by the jury following their deliberations on the evidence for approximately two hours.

Anand Beharrylal was instructed by Messrs AP Law for the first defendant.
