Man acquitted of multiple allegations of rape and sexual assault
Liam Walker recently concluded the trial of MB, who was unanimously acquitted following a three week trial at Basildon Crown Court. MB was charged with rape, attempted rape and three counts of sexual assault. The Crown alleged that three separate complainants had been the subject of sexual assaults committed by MB over the course of a year.
Due to the particular facts of the case, the evidential presumptions created by s75 and s76 of the Sexual Offences Act 2003 were argued in full. The case raised complex legal issues which have yet to be determined by the Court of Appeal.
Following submissions, the jury were directed by the judge to enter a verdict of not guilty on one of the counts. On 25 January 2010, after two days of deliberations, the jury returned verdicts of not guilty on all remaining counts.
